French filmmaker Louis Malle became interested in the Texas fishing confrontations after reading New York Times reports by journalist Ross Milloy. As an immigrant himself, Malle felt personally invested in telling the story of refugees confronting hostility in their adopted country. He traveled to Texas with screenwriter Alice Arlen to research the events, and Milloy’s reporting became the narrative foundation of the film; Milloy ultimately received an executive-producer credit. Malle was so committed to the project that he personally financed its pre-production and was prepared to fund the entire movie himself before TriStar Pictures stepped in with a $5 million budget. The production then filmed on location in Rockport-Fulton Beach, near the communities where the real confrontations had occurred, giving the drama an unusually direct connection to the setting that inspired it.
